Sideswipe Leads to Arrest

Thu, 05/23/2019 - 06:33

Monica M. Miller of Sag Harbor, 50, was arrested Saturday night on a felony charge of drunken driving following an accident in that village.

Police said they found Ms. Miller in the driver’s seat of a car stopped partially in the southbound lane of Hampton Street at about 11:30 p.m. The front passenger side of the car was damaged and she had hit a parked car.

Ms. Miller told police she had fallen asleep. Police said that due to the severity of the accident, she was taken to Stony Brook Southampton Hospital for medical attention. After treatment, she was taken to Sag Harbor Village police headquarters, where she was held for a morning arraignment. She was charged at the felony level because of a prior D.W.I. conviction, from December 2008.

In Montauk on Sept. 3, Labor Day, East Hampton Town police stopped Max J. Tierno, 28, of Manhattan for speeding. Police said they clocked a 2016 Volkswagen at 62 miles per hour in a 40 m.p.h. zone on Flamingo Avenue near Falcon Place, at 10:20 p.m.

When officers spoke to Mr. Tierno they felt he was under the influence of alcohol. He was charged with aggravated driving while intoxicated; his blood-alcohol level reportedly registered above .18.

Justice Steven Tekulsky arraigned him in East Hampton Town Justice Court the next day and released him on $500 bail.

Charles J. Mallo, 27, of Statesville, N.C., was also charged with misdemeanor D.W.I. Police said his 2010 Ford Fusion was going 61 m.p.h. in a 40 m.p.h. zone on Three Mile Harbor Road, East Hampton, near McElnea Street, on Friday at about 2:30 a.m.

Justice Tekulsky released him on $250 bail after a morning arraignment. He will be back in court at a future date.
