According to a report released this week, two men arrested in Amagansett in mid-June and charged with felony possession of a controlled substance with intent to sell, are still at large, awaiting future court appearances.
Byron Antonio Penafiel Rivera, 41, of Brooklyn, was pulled over on Montauk Highway near Abraham’s Path in the early morning hours of June 13. In the Jeep he was driving, East Hampton Town police said they found $2,100 in cash and multiple small glassine bags of a white powdery substance that later tested positive for cocaine. In all, the drugs weighed over an eighth of an ounce.
Mr. Penafiel Rivera’s passenger, Juan Carlos Gonzalez Cuautle, 47, of Yonkers, N.Y., he was implicated in the crimes by Mr. Penafiel Rivera, who, reports indicate, made a statement to police.
The driver was additionally charged with aggravated unlicensed operation in the second degree; police say his license showed three or more suspensions.
The men spent the night of the arrest in cells and were arraigned here the next morning by Justice Davis Filer, who released them on their own recognizance.
Gonzalez is due back in East Hampton Town Justice Court on Oct. 7. Penafiel Rivera is scheduled to be back on Oct. 15.
