Assault With a Wine Bottle

A violent assault over the weekend left one man injured and another in jail.

East Hampton Town police charged Daniel Colin Garduno, 28, with assault in the second degree, a felony, after he allegedly hit another man on the head with a glass wine bottle. It happened on Saturday morning at 11:30, at Pepperoni’s Pizza on Springs-Fireplace Road. Mr. Garduno was additionally charged with endangering the welfare of a child, a misdemeanor. According to the police report, the attack occurred in the presence of an 8-year-old. It did not identify the child’s relationship to either man.

The victim, whom police did not identify, suffered a laceration to the left side of his head, according to a report.

Capt. Gregory Martin, a police spokesman, said the two men were known to each other, but did not elaborate on the nature of the argument that led to the assault.

Justice David Filer arraigned Mr. Garduno on Sunday morning and set bail at $10,000. This was apparently the defendant’s second assault charge in less than a year; the first, which happened outside the same pizzeria and reportedly involved a different victim, was in September.

If found guilty, Mr. Garduno could face up to seven years in prison.
