A man with two names, wanted after he failed to show up in Suffolk District Court five years ago to answer a drunken-driving charge, was arrested in East Hampton last week, charged once again with driving while intoxicated.
East Hampton Town police pulled over a 2005 Toyota on North Main Street, near Cedar Street, after seeing its 36-year-old driver cross the solid white line at about 8:45 p.m. on Nov. 16.
The driver appeared intoxicated, police said. He gave his name as Francisco X. Gomez-Berrezueta, with an address in East Hampton, though police found through state records that he also goes by Xavier Gerrero, with the same birth date.
A check of his license showed it had been revoked in 2014 for his refusal to submit to a chemical breath test, and suspended three times later that year for failure to appear. It was suspended once again in 2015 for failure to pay a driver-responsibility assessment, and has not yet been restored.
He was charged with aggravated unlicensed operation of a motor vehicle, a felony, and with misdemeanor aggravated D.W.I., as his breath test last week, police said, produced a reading above .18. The legal limit is .08.
East Hampton Town Justice Lisa R. Rana released him on his own recognizance on the charges in the local court before turning him over to Suffolk County police on the warrant.
An Amagansett man with a prior D.W.I. conviction was hit with a felony charge on Nov. 15. David H. Elze, 37, was driving a 2006 Nissan Sentra east on Fort Pond Boulevard in Springs when he was stopped by town police for an alleged traffic infraction near Florence Street, at about 11:20 p.m. He exhibited signs of intoxication, police said.
Police said his record revealed a drunken-driving conviction in Suffolk County on Nov. 20, 2014. The new charge was then elevated to a felony because the prior offense occurred within the last 10 years. Mr. Elze was held overnight and arraigned on Nov. 16. Justice Rana released him on his own recognizance.
A Springs man was charged with D.W.I. Friday night after he was found driving at more than twice the legal limit for alcohol, according to town police.
Manuel J. Mayancela-Monte, 42, was behind the wheel of a 2004 Toyota heading north at a very slow rate of speed, impeding the flow of traffic, on Springs-Fireplace Road near Old Stone Highway in Springs. Police pulled him over at about 6:30 p.m. He appeared intoxicated and a breath test gave a reading at or above .18, according to police.
He was charged with aggravated D.W.I., a misdemeanor, due to the high blood-alcohol reading, and was held overnight for a Saturday-morning arraignment before Justice Steven Tekulsky. He was released on his own recognizance.
In the early morning hours on Sunday, a 43-year-old man was arrested for allegedly driving while intoxicated through East Hampton Village.
Ivan Campos-Bermudez of Hampton Bays was at the wheel of a 2015 GMC pickup truck, southbound on North Main Street at about 1:20 a.m., when an officer on D.W.I. enforcement patrol noticed he had failed to turn right on Newtown Lane, despite being in the turn-only lane. He continued straight on Main Street and was pulled over. He had trouble locating his registration information, police noted, and admitted to drinking two beers about three hours earlier.
He was not able to perform field sobriety tests as instructed, according to police, and was placed under arrest just before 2 a.m., charged with misdemeanor D.W.I. and a traffic infraction.
Mr. Campos-Bermudez was released on his own recognizance following arraignment in Justice Court on Sunday.
Also on Nov. 16, Scott E. Raynor, 38, of Springs was arrested on a misdemeanor D.W.I. charge following a traffic stop at about 1:40 a.m. He was driving north in a 2002 Ford on Springs-Fireplace Road near Harrison Street in Springs, when, officers said, he swerved several times, straddling the double yellow line for several feet. He allegedly performed poorly on all field sobriety tests.
Justice Rana released him on his own recognizance later that morning following arraignment.
