NOTICE IS HEREBY GIVEN that the Board of Education of the East Hampton Union Free School District, in the County of Suffolk, New York, has adopted a resolution on January 26, 2010, authorizing a Special District Meeting of the qualified voters of said School District to be held on Wednesday, March 24, 2010 from 3:00 o’clock P.M. to 9:00 o’clock P.M. (Prevailing Time) at the East Hampton Middle School, 76 Newtown Lane, East Hampton, New York, for the purpose of voting upon the following Bond Proposition:
BOND PROPOSITION
RESOLVED:
(a) That the Board of Education of the East Hampton Union Free School District, in the County of Suffolk, New York (the District), is hereby authorized to undertake a Transportation Building Project (the Project) substantially as described in a plan prepared by the District with the assistance of Beatty, Harvey & Associates, Architects (the ìPlanî), available for public inspection in the office of the District Clerk, consisting of (i) the acquisition of a parcel of land consisting of approximately 2.8 acres, including the building and appurtenances situate thereon, located at 29 King Street in the Incorporated Village of East Hampton, in the District, at the estimated cost of $3,250,000; and (ii) the partial reconstruction of, and construction of an addition and improvements to, said building and site, including the construction of additional service bay space; improvements to the heating, ventilation, air conditioning, electrical and plumbing systems; interior reconstruction and space reconfiguration; the installation of above ground storage tanks; improvements to enhance accessibility by the physically challenged; and the installation of new doors, ceilings, floors, and partition walls; at the estimated cost of $822,917; all of the foregoing to include the original furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs and costs incidental thereto and to the financing thereof, an amount not to exceed the estimated total cost of $4,072,917; provided that the costs of the components of the Project as set forth in detail in the Plan may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;
(b) that a tax is hereby voted in the amount of not to exceed $4,072,917 to finance such cost, such tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and
(c) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the aggregate principal amount of not to exceed $4,072,917 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.
Such Bond Proposition shall appear on the ballot labels to be inserted in the voting machines used for voting at said Special District Meeting in substantially the following condensed form:

NOTICE IS FURTHER GIVEN that pursuant to Education Law ß2014, personal registration of voters is required, and no person shall be entitled to vote at the Special District Meeting whose name does not appear on the register of the District. The Board of Registration will meet at the East Hampton District Office, 231 Pantigo Road, East Hampton, New York, on Wednesday, March 10, 2010, from 8:00 o’clock A.M. to 4:00 o’clock P.M. (Prevailing Time) for the purpose of preparing a register of the qualified voters of the District for said Special District Meeting, at which time any person shall be entitled to have his/her name placed upon such register, provided that at such meeting of the Board of Registration he/she is known or proven to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at said Special District Meeting.
The register of the qualified voters of said District prepared for the Annual District Meeting held on May 19, 2009, shall be used by said Board of Registration as the basis for the preparation of the register for said Special District Meeting to be held on March 24, 2010. DATED JANUARY 26, 2010 REGARDING THE TAKING OF SOFT CLAMS IN ACCABONAC AND THREE MILE HARBORS
The following Resolution was adopted by the Trustees of the Freeholders and Commonalty of the Town of East Hampton:
WHEREAS, Section 213-10(B) of the Town Code prohibits the taking of shellfish in any manner other than by hand power; and
WHEREAS, Section 213-16(B) of the Town Code prohibits the taking of soft clams between May 1 and August 31 of each year; and
WHEREAS, Section 213-18 of the Town Code recognizes the Trustees’ authority to vary the methods, equipment and permissible dates for the taking of shellfish in such areas as the Trustees shall designate; and
WHEREAS, the East Hampton Town Baymen’s Association has requested that the taking of soft clams by holders of Commercial Shellfish Permits from portions of Accabonac Harbor and Three Mile Harbor by the method known as “churning” or “powering”; and
WHEREAS, in 1993 the Trustees received a similar request and, by Memorandum dated 6/1/93, the East Hampton Town Director of Natural Resources advised the Trustees that “churning” will result in very little impact of a harmful and/or serious nature and that it is quite possible that sets of bivalves in the target area will be enhanced as the “churning” impacts will tend to reduce predator populations (e.g., lady crabs) more than prey, or harvestable, bivalve populations; and
WHEREAS, the Trustees have authorized the taking of soft clams by “powering” or “churning” during the summer months on a number of occasions since 1993 and those experiences have demonstrated that “powering” or “churning” is not detrimental to the shellfish population or the environment and is beneficial to the economic well-being of those who rely upon town waters for their livelihoods.
NOW THEREFORE BE IT RESOLVED, 1. Notwithstanding the permissible dates, and methods for the taking of soft clams set forth in Sections 213-10(B) and 213-16(B) if the Town Code, the Trustees hereby designate and approve the following Special Season and Designated Areas for the harvesting of soft clams by the method known as “churning” or “powering” on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays during the period commencing February 8, 2010 and ending April 30, 2010 inclusive: ACCABONAC HARBOR:
a) The western portion of Accabonac Harbor defined as that portion of the Harbor below the low tide line lying north of a line extending from the south boundary of the Merrill Lake Sanctuary to the north boundary of the Kaplan Meadows Sanctuary.
b) The area around Wood Tick Island, excluding the southern shore.
THREE MILE HARBOR: The area lying from the entrance to Hands Creek north to a line 1000’ (one thousand feet) south of the dirt road east of Sammy’s Beach Road, within 100’ (one hundred feet) of shore. 2. Only persons who possess a valid “Commercial License for the Taking of Shellfish from Town Lands” shall be eligible to participate in the special season described in Paragraph 1. The special season shall be subject to such conditions, rules and regulations as the Trustees shall impose thereon. 3. The special season shall authorize the taking of soft clams by the technique known as “churning” or “powering” with a propeller and only on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays between February 8, 2010, and April 30, 2010, during daylight hours only. No other method of taking is authorized. Soft clams may not be taken from any areas other than those specified in Paragraph 1. 4. No person shall take more than three (3) bushels of soft clams per day from the any or all of the areas described in Paragraph 1. All clams so taken shall be placed in either wire or plastic bushel baskets. No person shall possess any quantity of soft clams that do not fit flush within said baskets. 5. Any boat containing soft clams in Accabonac or Three Mile Harbors on days when “churning” or “powering” is permitted, shall be subject to inspection by the Trustees or their representative. 6. AND BE IT FURTHER RESOLVED, this Resolution shall take effect upon the filing of the same with East Hampton Town Clerk and posting as set forth in Section 213-18 of the Town Code, and shall expire on April 30, 2010.
